I am a WAH mom with an 8 year old boy. I left a very abusive marriage to my ex who was diagnosed with Borderline Personality Disorder. I am slowly building my publicity business and have picked up part time work to provide a good quality of life for my son and I. It has been a challenge with the economy the way it is. Recently my ex decided unilaterally to reduce child support by a significant amount, stating that health insurance for our son that he pays increased by 50%, that he can't afford it and therefore is reducing child support. Meanwhile, he pulls in a 6 figure salary. Legally, he is not allowed to reduce child support and additionally child support and health insurance are two separate issues. Has anyone experienced anything like this? Any advice on how to handle?

I'm so sorry that you were in that type of situation.

It's very strange that health coverage would just jump by 50% out of the blue??? If he is a bully and is unilaterally deciding that your child support is now reduced, then I don't think you have option other than to contact a Family Law Attorney.

It may be a good idea to first of all contact your local citizens advice centre.

If you have a court order, you will need to file to force him to pay. Usually your local child support enforcement office can help with that so you won't have to get a lawyer, but I am not sure how behind he has to be in order for them to help. Otherwise you could get a lawyer.

Just so you know in most states Non Custodial Parents will get a deduction in child support if they're providing insurance but you're right, he is not allowed to just cut it, he must seek a modification.

So, go to your child support enforcement office, or call them, see what they say. Then if you must, get an attorney.

Thank you for your comment. Yes, health insurance for an 8 year old increased by 50% is hard to believe. He is a bully and will continue to make unilateral decisions until I set some legal boundaries.

Thanks Stephanie. I appreciate your time and advice. I have a signed agreement and a judgement that was filed with the courts. I know it's unlawful, however, unless I set legal limits he will continue. It's expensive to hire a good attorney who knows the law and can add value. I'll see what information I get from the cseo.
